    Default New 2 Stroke Emission laws in California

    This is such a grey law. I see posts on Craigslist like this:
    This is a reply to who left the post about the 2 stroke law in 2013 and not to worry, well your post is wrong, what will happen with old 2 stroke motors is you will not get new tags after 2013, no tags no use, theirs your inspection right there, yes they have your info on your boat or jet ski in the system and what type of motor.

    So buyers beware if you buy a older jet ski with 2 stroke you will only have 2 years of use than its junk.. same law is also going in many other states..

    Despite rumors to the contrary, the 2-stroke ban on Lake Mead applies
    ONLY to PWC (SeaDoo/JetSki's) not boats with outboard motors.

    Here's the actual law, linked to the FAQ web site:

    36 CFR 7.48 (f)(3) - After December 31, 2012, no one may operate a personal watercraft (PWC) that does not meet the 2006
    emission standards set by EPA for the manufacturing of two-stroke engines. A person operating a personal watercraft that meets the
    EPA 2006 emission standards through the use of direct-injection two-stroke or four-stroke engines, or the equivalent thereof, is not subject
    to this prohibition and will be allowed to operate as described in this section.

    The way I read this is that my 1998 GTX RFI is exempt.
    There is a bunch of ejumencated Californians here. You views?

    To me it reads if they don't meet 2006 EPA standards. So what are the standards? Modified skis??.. Tuned pipes??
    Do stock factory exhaust systems comply?

    Best bit about living in Oz. Surrounded by ocean! Plenty of places to ride my ski or take the boat!!

    1) They will fight it, and it will get overturned. (They were trying this crap back in the early 90's) All it will take is a group of people and a lawyer. It is not legal for them to make a vehicle illegal, since it was sold in that state as a legal vehicle.

    2) If they allow carb 2-stroke outboard engines... they will have to allow PWC.

    3) Your RFI is not a "Di" (Direct Injection) engine... so you wouldn't be exempt.

    It sucks when this kind of stuff happens... but it can be an easy over-turn of the law since all of the old vehicles would have to be "Grandfathered" in. Also... if the Federal laws still say it's legal... then that will be used as an over turn point also. (States can't superseded the feds)

    NOW... a single community can ban something... but they will have to ban all 2-strokes. BUT... since I think Lake Mead is a US Army Corps lake... then NV really has no true jurisdiction on it.



    Basically... they can write any law they want... but it doesn't make it legal... and it doesn't mean it will stay, as long as someone is willing to fight it.

    One last thing.....


    I lived in So Cal for the better part of my life... and the only people who go to Lake Mead were the tourist anyway. It's kind of like all the people who would go to Palm Springs for spring break.

    If you live in So Cal... you are playing in the ocean, or going out to the Colorado river. (or to any of the 100's of other recreational lakes)


    When you live in a tourist vacation spot... you have a tendency of seeking out the "Local's Only" places.

    Lake Mead is owned by the US dept. of the interior.

    SO..........


    A local law can't claim jurisdiction on a Fed owned lake.

    The lake that we boat on is actually owned by the local power company, Kentucky Utilities. And since it is technically a private lake they have instituted their own rules, one of which I whole heartily agree with, it's a "dry" lake, no alcohol is allowed on the lake period.

    We have officers of the KY State Fish and Game patrolling the lake and this rule is strictly enforced. Alcohol open or not is confiscated and people using or even in possession are subject to ticketing and arrest. The only alcohol on the lake is in the gas.
